What are the crucial points that a residential lease agreement should cover?

A secure Residential Lease Agreement should clearly detail: 1) The adjustment index (usually the IPCA, after the shift in focus from the IGP-M); 2) The type and value of the guarantee (security deposit, surety bond, or guarantor); 3) The rules for inspection and maintenance of the property; and 4) The termination clauses and applicable penalties in case of breach of contract. Our consultancy ensures that your contract minimizes future litigation.
The first step is formal notification to the tenant. If the debt persists, the solution is an Eviction Action for Non-Payment, combined with the collection of overdue rent. Our legal practice is focused on conducting the process with maximum speed to regain possession of the property and recover the amounts owed.
In fixed-term contracts, the landlord (owner) cannot reclaim the property before the end of the term, except in cases of serious breach of contract by the tenant. However, after the term expires, if the tenant remains, the owner may request repossession at any time, by giving notice.
The main difference lies in the protection of the business location. In commercial leases, the tenant has the right to a renewal action after 5 years of the contract and compliance with other legal requirements, aiming to protect their goodwill. Residential leases do not have this rule. Furthermore, the intended uses of the property and the rules regarding improvements vary.
The tenant may only sublet, lend, or assign the rented property if there is express written authorization from the landlord (owner), as stipulated in the Tenancy Law. Without this authorization, subletting is considered a serious breach of contract and may lead to eviction proceedings.
