What is the essential role of legal counsel before participating in an auction?

The essential role is the prior Legal Due Diligence. Before you place a bid, the lawyer conducts an analysis of the auction notice and the judicial or extrajudicial proceedings. This analysis identifies hidden debts (property tax, condominium fees) and verifies the existence of lawsuits that could invalidate the auction, ensuring that your investment does not become a future problem.
It depends on the origin of the debt and what is written in the auction notice. Property tax (IPTU) and condominium debts are, as a rule, of a propter rem nature (they follow the property). If the auction notice is silent on the matter or states that the debts will be the responsibility of the winning bidder, the buyer inherits them. Our consultancy guarantees a correct reading of the auction notice to anticipate these costs and, if possible, obtain the settlement of these debts with the auction proceeds.
Writ of Possession is the legal measure necessary for the successful bidder (the new owner) to take physical possession of a property that is still occupied by the former owner or tenant. The lawyer acts immediately after the auction to file the Writ of Possession action, ensuring the swift execution of the court decision so that you can use or generate income from the property.
Judicial auctions (resulting from a court process) generally carry clearer risks, but the eviction (possession order) is handled within the process itself, which is an advantage. Extrajudicial auctions (conducted by banks or trustees) tend to be faster, but the possession order usually requires a separate legal action and may have more risks if the bank does not follow all legal procedures.
Yes, an auction can be annulled, which is one of the biggest risks for the investor. The most common causes of annulment involve the lack of proper notification to the debtor about the auction dates or errors in the auction notice.
